If the application doesn’t meet these criteria, a ‘first-stage’ partner visa is granted. After two years from the initial application, the applicant will have the chance to apply for permanent residency again. At that stage, additional eligibility requirements must be met, and further representation is required before a decision on permanent residency is made.

Partner Visa-309

The Subclass 309 visa offers a pathway to residency in Australia for individuals who are either married to or in a de facto relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. This is a temporary (provisional) visa granted based on your relationship, allowing you to live, work, and study in Australia while your permanent visa is processed. The second-stage permanent visa (Subclass 100) is usually assessed two years from the date of the initial partner visa application but may be granted sooner if sufficient evidence of your relationship history is provided. Your partner will act as your sponsor, agreeing to support you with accommodation and financial assistance during the first two years of your stay in Australia on this visa.

Partner Visa-820 from 300

The Subclass 820 visa offers a pathway to residency in Australia, based on your relationship or recent marriage. It’s the first step in a multi-stage process, starting with this visa, followed by a provisional partner visa, and ultimately leading to a permanent partner visa, which grants permanent residency.
Visa holders must marry their partner within 9 months of the visa grant and then apply for the onshore Partner Visa (Subclass 820). This visa has a lower evidence threshold for proving the relationship, and living together is not a requirement. It’s ideal for committed couples who may not meet the cohabitation criteria required for other partner visas.

Partner Visa -820 The Subclass 820 visa offers a pathway to residency in Australia for couples who are either married or in a de facto relationship.
